This law firm represents Biopharma International and Kurabiol Laboratories in North America, Central America, South America, and the Caribbean. Biopharma International in the U.S. which is the exclusive authorized sales representative of Biocell Ultravital world-wide; and Kurabiol Laboratories in the U.S. which manufactures FDA approved food supplements and other products in the U.S. for Biocell Ultravital. We also represent Biocell Laboratoire in Montmorency, France, which manufacture products for Biocell Ultravital for the CE market.

Since 2007, we have been investigating certain companies including Vitacell Laboratories, MxPharmaceutic Group, RCA Laboratorios SL, Terapias de Salud, RevitaliCell, Pharmabiol Research GmbH, and Ultravital (sometimes collectively referred to as the “Sham Companies”).  We have employed attorneys and investigators in many countries including Mexico, Venezuela, Panama, Colombia, Argentina, Spain, France, Switzerland, and the U.S. to investigate the bona fides of these Sham Companies.  Our investigations have concluded that none of these Sham Companies are properly registered or licensed in their alleged countries of operation.

  • Vitacell Laboratories (“VITACELL”), which is allegedly located in Lucerne, Switzerland (www.vitacell-laboratory.com), is NOT a legitimately registered Swiss company and does not appear in the records of the official government company registry or the Lucerne Chamber of Commerce. (Attachment A-1 & A-2).

  • MxPharmaceutic Group (“MXPHARMA”), which is allegedly  located in Miami, Florida (www.mxpharmaceuticgroup.com), is NOT a legitimately registered U.S. company and does not appear in the records of the State of Florida Division of Corporations. (Attachment B).

  • RCA Laboratorios SL (“RCA LABS”), which is allegedly located in Barcelona, Spain (www.rcalaboratorios.com), is NOT a legitimately registered Spanish company and does not appear in the records of the official government company registry or the Barcelona Chamber of Commerce. (Attachment C-1 & C-2).

  • Terapias de Salud (“TERAPIAS SALUD”), is allegedly located in Monterey, Mexico (www.terapiasdesalud.com), and is an authorized dealer of MXPHARMA and it  distributes products which are allegedly manufactured  in Switzerland by VITACELL.

  • RevitaliCell (“REVITALICELL”), which is allegedly located in France (www.revitalicell.com), is NOT a legitimately registered French company and does not appear in the records of the official government company registry or anywhere in the official CE company registry.

  • Pharmabiol Research GmbH (“PHARMABIOL”), which is allegedly located in Switzerland (www.pharmabiol.com), is NOT a legitimately registered Swiss company and does not appear in the records of the official government company registry. (Attachment D).

  • Ultravital (“ULTRAVITAL”), which is allegedly located in Switzerland (www.ultravital.ch  &  www.ultravital.net), is NOT a legitimately registered Swiss company and does not appear in the records of the official government company registry. (Attachment E).

VITACELL/MXPHARMA

  • VITACELL (and MXPHARMA advertise many different fake, knock-off, and counterfeit products on their websites including the following: V-HUMACELL, V-CELUPLACELL, ANTI-AGING VACCINE, EMBRYONIC ANTI-AGING COMPLEX, MULTIORGANIC COMPLEX FOR MEN & WOMEN.
  • The products advertised on the VITACELL and MXPHARMA websites give the impression to the consumer that they are manufactured in Switzerland and are compliant with Swiss and CE health regulations, when the opposite is true. The following false  claims are contained on the websites:

    Vitacell Laboratory is located in Lucerne, Switzerland, and we are pioneers in cellular therapies, and our products are elaborated with the best quality and with the control of the European Community.

  • The primary and secondary packaging, the information inserts, the brochures and    catalogues, and the product descriptions on the websites, all contain false and misleading information as to source, origin, ingredients, place of manufacture, and quality control, and these fraudulent misrepresentations place the consumers in peril of injury and/or death.
  • VITACELL and MXPHARMA published a letter dated June 10, 2010 whereby they stated that they possessed a “special” FDA Registration. (Attachment F).

  • The VITACELL and MXPHARMA websites also published the same false information:

    Vitacell Laboratory is the only cellular therapy approved by the FDA. Our products are the best quality and have been approved by the European Community and the FDA under a special FDA permission (FDA Reg. No. 16294010804).

  • This information falsely claims that the products of VITACELL and MXPHARMA have been officially certified/approved by the FDA, which is blatantly untrue, and such false statements are criminal acts. We have contacted the FDA and they have confirmed that these claims are false and they have commenced a criminal investigation. (See FDA email below.)

I am in receipt of your letter.  I apologize for not getting back with you sooner, but I have not been in the office.

Currently, I am unaware of any “special FDA Registration” that may be applied for and/or granted to  Vitacell Laboratories/MxPharmaceutic Group. In addition, the FDA Reg. #16294010804  does not appear to be consistent with our current format for registration number(s).  We will look into and investigate the matter further.

  • VITACELL and MXPHARMA have committed criminal acts by creating a fraudulent website (www.fraudebiocell.com) which disparages Biocell Ultravital and contains false information which misleads the consumer. (Attachment G).

  • VITACELL and MXPHARMA have committed criminal acts of “falsification” by using forgery and deception to advance a criminal conspiracy against Biocell Ultravital. They have altered a letter from the former Swiss attorneys of Biocell Ultravital, and this “fake” letter used the letterhead of the Swiss law firm without their permission and the signature of Biocell Ultravital’s lawyer was forged. (Attachment G).

  • The legitimate law firm representing Biocell Ultravital in Switzerland (“Swissberg”) filed a response to the fake letter wherein it accused VITACELL, MXPHARMA, and RCA Labs of criminal acts, including falsification, forgery and fraud. (Attachment H).

  • VITACELL and MXPHARMA are part of a criminal conspiracy and these companies have used fake letters and fake websites to confuse the consumers and hide behind a wall of lies. They do not follow the ethical rules of conduct of legitimate companies and have committed many criminal acts including falsification, forgery and fraud.

  • VITACELL and MXPHARMA are operating illegally and clandestinely and no legitimate law firm has ever pursued a legal action against Biocell Ultravital on their behalf  even though these companies have threatened to pursue litigation on many occasions.  These companies has used fake letters and fake websites to confuse the consumers and continue to hide behind a wall of lies, and they do not follow the ethical rules of conduct of legitimate companies and have committed criminal acts such as falsification, forgery and fraud. No person or legitimate entity has ever come forward and identified themselves to defend any of these companies, and the principals of VITACELL and MXPHARMA continue to hide behind fake websites and the Sham Companies.

RCA LABS

  • RCA LABS (www.rcalaboratorios.com) advertises many different fake, knock-off, and counterfeit products on its website including the following: HUMAN REVICELL, ANTI-AGING VACCINE, HUMAN CELL THERAPY, MULTI ENERGY FORTE FOR MEN &  WOMEN.

  • The products advertised by RCA LABS on its website gives the impression to the consumer that they are manufactured in Barcelona, Spain and are compliant with Spanish and CE health regulations, when the opposite is true, as RCA LABS is not even registered in Spain and does not appear in the official records of the Spanish Company Registry or the Barcelona Chamber of Commerce.

  • The primary and secondary packaging, the information inserts, the brochures and    catalogues, and the product descriptions on the websites, all contain false and misleading information as to source, origin, ingredients, place of manufacture, and quality control, and these fraudulent misrepresentations place the consumers in peril of injury and/or death.

  • RCA LABS  advertises on its website that its Human Revicell products possesses a U.S. Federal Trademark Registration (HUMAN REVICELL®) when in fact the opposite is true as no such valid Registration exists. A search of the USPTO official website shows that no such Trademark exists, and such misrepresentation is contrary to U.S. law. (Attachment I).

  • RCA LABS has committed criminal acts by using forgery and deception to advance a criminal conspiracy against Biocell Ultravital. They (along with VITACELL and MXPHARMA) have altered a letter from the former Swiss attorneys of Biocell Ultravital. This “fake” letter used the letterhead of the Swiss law firm without their permission and RCA LABS is identified in the fake letter as the client. (Attachment G).

  • The legitimate law firm representing Biocell Ultravital in Switzerland (“Swissberg”) filed a response to the fake letter wherein it accused VITACELL, MXPHARMA, and RCA LABS of criminal acts, including falsification, forgery and fraud. (Attachment H).

  • RCA LABS (along with VITACELL and MXPHARMA) is operating illegally and clandestinely and no legitimate law firm has ever pursued a legal action against Biocell Ultravital on its behalf even though it has threatened to pursue litigation on many occasions.  This company has used fake letters and fake websites to confuse the consumers and continues to hide behind a wall of lies, and it does not follow the ethical rules of conduct of legitimate companies and has committed criminal acts such as falsification, forgery and fraud. No person or legitimate entity has ever come forward and identified themselves to  defend it, and the principals of  RCA LABS (along with VITACELL and MXPHARMA)  continue to hide behind fake websites and the Sham Companies.

TERAPIAS SALUD

  • TERAPIAS SALUD advertises many different fake, knock-off, and counterfeit products on its website including the following: V-HUMCELL, V-CELUPLACELL.
  • The products advertised TERAPIAS SALUD on its website gives the impression to the consumer they are manufactured in Switzerland and are compliant with Swiss and CE health regulations, when the opposite is true.

                V-Humacell is a product of Vitacell Laboratory, a company located in Lucerne Switzerland, dedicated to medical and biological research and the production of a high technology, which includes the latest advances molecular therapies and         therapies catalytic enzymes.

  • The primary and secondary packaging, the information inserts, the brochures and    catalogues, and the product descriptions on the websites, all contain false and misleading information as to source, origin, ingredients, place of manufacture, and quality control, and these fraudulent misrepresentations place the consumers in peril of injury and/or death.

  • TERAPIAS SALUD claims to be an authorized dealer of MXPHARMA, and it  advertises, distributes and sells  many different fake, knock-off, and counterfeit products which are allegedly manufactured  in Switzerland by VITACELL. (Attachment J).

  • TERAPIAS SALUD is operating illegally and clandestinely in concert with VITACELL, MXPHARMA, and RCA LABS, and these companies are all part of a criminal conspiracy. These companies have used fake websites to confuse the consumers by selling fake, knock-off, and counterfeit products and have committed criminal acts such as falsification, forgery and fraud.

REVITALICELL

  • REVITALICELL advertises many different fake, knock-off,  and counterfeit products on its websites including the  following: HUMAINE ANTI-AGING VACCINE, HUMAINE CELLULAR THERAPIES.

  • REVITALICELL uses false and misleading information which is intended to cause confusion with the consumer by giving the false impression that this company is located in France, and that the products  are manufactured with  governmental quality control in France.  This information is false and is intended to mislead and confuse consumers.  (Attachment K).

  • The primary and secondary packaging, the information inserts, the brochures and    catalogues, and the product descriptions on the websites, all contain false and misleading information as to source, origin, ingredients, place of manufacture, and quality control, and these fraudulent misrepresentations place the consumers in peril of injury and/or death.

  • REVITALICELL is operating illegally and clandestinely in concert with VITACELL, MXPHARMA, and RCA LABS, and these companies are all part of a criminal conspiracy. These companies have used fake websites to confuse the consumers by selling fake, knock-off, and counterfeit products and have committed criminal acts such as falsification, forgery and fraud.

PHARMABIOL

  • PHARMABIOL advertises many different fake, knock-off, and counterfeit products on its website including the following: ANTI-AGING VACCINE, MEGACELL, HUMAIN MEGACELL, FEMOCELL, ANDROCELL.

  • PHARMABIOL uses false and misleading information which is intended to cause confusion with  the consumer by giving  the false impression that this company is located in Switzerland when  the company is not even registered in  Switzerland.

  • The products advertised on the PHARMABIOL website give the impression to the consumer that they are scientifically researched, that they are manufactured with  governmental quality control,  and that the company employs  well qualified scientists to supervise the types of products that the company markets. This information is false. (Attachment L).

  • The primary and secondary packaging, the information inserts, the brochures and    catalogues, and the product descriptions on the websites, all contain false and misleading information as to source, origin, ingredients, place of manufacture, and quality control, and these fraudulent misrepresentations place the consumers in peril of injury and/or death.

  • In its website in a section named “IMPORTANT MESSAGE”, PHARMABIOL  acknowledged that Biocell Laboratories had started an  advertising campaign to educate the general public concerning  the fraudulent products offered by PHARMABIOL.  The information contained in the webpage consisted of false and misleading information which was intended to cause confusion with the consumer by giving  the false impression that this company was located in Switzerland and that their products were legal, safe, and effective  products.  (Attachment M).

  • PHARMABIOL advertises on its website that all of its products possess a U.S. Federal Trademark Registration when in fact the opposite is true as no such valid Registrations exist. A search of the USPTO official website for ANDROCELL®, FEMOCELL®,MEGACELL®, and OLIGOCELL®, shows that no such Trademarks exist, and such misrepresentations are contrary to U.S. law. (Attachment N).

ULTRAVITAL

  • ULTRAVITAL advertises many different fake, knock-off, and counterfeit products on its website including the following: SUPRACELL ULTRA, BIOFEMME, THYMOCELL, BIORGANE ULTRA COMPLEX, THYMOCELL, EMBRIOCELL, ANDROCELL, THYMORGANE.

  • ULTRAVITAL  uses false and misleading information which is intended to cause confusion with the consumer by giving  the false impression that this company is located in Switzerland when  the company is not even registered in  Switzerland but it appears to be located in Mexico.

  • The products advertised on the ULTRAVITAL website give the impression to the consumer that they are scientifically researched, that they are manufactured with  governmental quality control,  and that the company employs  well qualified scientists to supervise the types of products that the company markets. This information is false and is intended to mislead and confuse consumers.

  • The primary and secondary packaging, the information inserts, the brochures and  catalogues, and the product descriptions on the websites, all contain false and misleading information as to source, origin, ingredients, place of manufacture, and quality control, and these fraudulent misrepresentations place the consumers in peril of injury and/or death.
  • ULTRAVITAL represents to the consumer that its products possess  Swiss Trademark Registrations when in fact the opposite is true as no such valid Registrations exist,  and such misrepresentations are contrary to Swiss law. (Attachment O).

  • ULTRAVITAL has illegally registered two domain names in Switzerland  (www.ultravital.ch  &  www.ultravital.net) which infringe on the valid domain names and  Trademark Registrations of  Biocell Ultravital,  and such misrepresentations are contrary to Swiss law. (Attachment O).

Our investigations have discovered that these Sham Companies are all using illegal tactics and artifice to shield the true owners of these companies from public scrutiny or investigation.

  • Some of the principals behind VITACELL, MXPHARMA, RCA LABS, TERAPIAS SALUD, and REVITALICELL, are Dr. Pedro Galo Aquilar, Salvador Cortez, Jorge Córdoba, Lic. Francisco Rebolledo, and Mauricio  Palacios Macias. We believe that Galo, Rebolledo,  Palacios and others, have operated an ongoing  criminal conspiracy against Biocell Ultravital and Biopharma International from Monterey, Nuevo León, México, and that they own and/or control VITACELL, MXPHARMA, RCA LABS, TERAPIAS SALUD, and  REVITALICELL.

  • Galo sent many emails starting on March 10, 2009 to Biocell Ultravital and Biopharma International, using foul language and threatening to ruin them and cause harm to Biocell Ultravital and Biopharma International with a variety of illegal conduct. (Attachment P).

  • Rebolledo sent an email on May 21, 2010 to the web designer (Delgar) hired by Biopharma International, threatening them with legal action because they had created a web page (www.v-humacell-fraude.com) that informed the general  public of the fraudulent products being distributed by VITACELL and MXPHARMA. The email advised them to immediately “erase” the website or litigation would be filed.   Biopharma International did not take down the website and no litigation was ever commenced by either Rebolledo or VITACELL/MXPHARMA.  (Attachment Q).

  • TERAPIAS SALUD is an authorized dealer of MXPHARMA  and it  advertises, distributes and sells  many different fake, knock-off, and counterfeit products which allegedly are manufactured  in Lucerne,  Switzerland  by  VITACELL, and Palacios is identified as the contact person for TERAPIAS SALUD on its website. (Attachment J).

  • A person identified as Laura Valdez from MXPHARMA, sent an email to Kurabiol Laboratories on June 21, 2010 in response to an inquiry from one of our investigators, where  she   claims  that  MXPHARMA distributes certain products from  VITACELL. (Attachment R).
  • PHARMABIOL and ULTRAVITAL and others, have operated an ongoing criminal conspiracy against Biocell Ultravital and Biopharma International.

  • The PHARMABIOL website identifies a physician as its medical director, who is allegedly well known in the field of geriatrics.  In fact he is not a physician and does not possess a medical degree and is a well known fraud and charlatan. (Attachment L).

  • PHARMABIOL is clandestinely operated and controlled by a Venezuelan company named Urbapharma as a “front” company in an attempt to shield Urbapharma from public scrutiny and criminal investigation.

  • ULTRAVITAL in allegedly located in Mexico, even though it advertises  that all of its products are manufactured in Switzerland. ULTRAVITAL registered two domain names (www.ultravital.ch & www.ultravital.net) in Switzerland which infringe on the valid domain names and  Trademark Registrations of Biocell Ultravital. (Attachment O).

We believe that these Sham Companies are operated by corrupt  and irresponsible persons who  intend to continue this criminal  conspiracy and fraud at all costs by  setting up new front companies  and fake websites. They will continue to use the Internet in an attempt to fool  and  obfuscate the general public into believing  that the products they offer are legitimate products. These Sham Companies  will continue to take advantage of the goodwill of consumers and they will continue to prey upon  the gullibility  of consumers and will attempt to discredit the bona fides of Biocell Ultravital and its affiliates.

It is relatively easy and cheap to use the Internet to disguise any crime, such as creating a fake website that disparages with false and misleading information. It is very difficult for the consumer to sift through the hundreds of websites and conflicting information to ascertain what is real and what is a scam.

An example of  how a consumer can help identify a fake company  occurred in Mexico, when a person named Mr. Gomez contacted  the Swiss Embassy in Mexico City and requested verification  as to the legitimacy of  Vitacell Laboratories,  versus Biocell Ultravital. He had found both companies on the Internet and both claimed to be located in Switzerland and both claimed to be the exclusive manufacturer  of anti-aging therapies, and he was confused as to which company was the legitimate one and which one was the fake. He did his research and the Swiss Embassy responded to his enquiry and verified that indeed Vitacell was the fake company.  (Attachment A-2).

  • It is clear that these Sham Companies and the con artists that hide behind them, have criminally conspired to defraud consumers with fake, knock-off, and counterfeit products, and have marketed products with false or misleading information.

  • It is clear that these Sham Companies and the con artists that hide behind them, have acted together and criminally conspired to defraud consumers and medical professional into purchasing misbranded and adulterated products by advancing misleading claims and false information which may cause harm and/or death. There is no indication of source or origin of these products, where the products were actually manufactured, how they were manufactured, and what the actual ingredients the products contain.

  • It is clear that the products distributed by these Sham Companies and the con artists that hide behind them, contain false and misleading information on the primary and secondary packaging, the information inserts, the brochures and catalogues, and the product descriptions on the websites. These fraudulent misrepresentations place the consumers in peril of injury and/or death.

  • It is clear that these Sham Companies and the con artists that hide behind them,  have acted together and criminally conspired to confuse and deceive consumers by creating different websites under different company names in an attempt to evade scrutiny and investigation.  These Sham Companies have committed consumer fraud by advertising their counterfeit products in radio, television, newspapers, and magazines, and we have gathered all these fraudulent advertisements as evidence of this fraud.
  • It is clear that these Sham Companies are not registered in their alleged countries of  operation and are not licensed or regulated by any governmental agency. There is no indication of source or origin of these products, where the products were actually manufactured, how they were manufactured, and what the actual ingredients the products contain. These products are misbranded and are adulterated and contain false and misleading information on the primary and secondary packaging, the information inserts, the brochures and  catalogues, and the product descriptions on the websites. These fraudulent misrepresentations place the consumers in peril of injury and/or death as there is no way to guarantee the bona fides of these products.
  • It is clear that these Sham Companies and the con artists that hide behind them, have violated FDA and FTC Statutes and Regulations in the U.S. and their equivalent laws in Mexico, Venezuela, Panama, Colombia, Argentina, Spain, France, and Switzerland.
  • It is clear that these Sham Companies and the con artists that hide behind them, have  committed trademark infringement, unfair competition, and copyright infringement in violation the  U.S. law and  their equivalent  laws in Mexico, Venezuela, Panama, Colombia, Argentina, Spain, France,  and Switzerland, as well as  International Conventions and Intellectual  Property Treaties.
  • It is clear that these Sham Companies and the con artists that hide behind them, are operating illegally and clandestinely and have never identified any legitimate law firm to represent their interests since these investigations began in 2007.  No law firm has ever pursued a legal action against Biocell Ultravital, Biocell Laboratories, Biopharma International, and/or Kurabiol Laboratories, on behalf of these Sham Companies because they understand that they will be found guilty of criminal conduct and will suffer adverse legal consequences as a result.
  • It is clear that none of these Sham Companies and the con artists that hide behind them, can demonstrate their legitimacy as it has been shown that none of these companies are legally registered as companies or corporations in any of their alleged countries of operation, do not pay  any sales tax on the  sales of the counterfeit and fake products, and they do not pay  taxes of any including  federal, state, or local governments,  corporate taxes, payroll taxes,  and import taxes or duties.

We therefore urge both consumers and medical professionals who have previously purchased products marketed or distributed by VITACELL, MXPHARMA, RCA LABS, TERAPIAS SALUD, REVITALICELL, PHARMABIOL, and ULTRAVITAL, to immediately cease from purchasing any products from these companies in the futurePublic safety is our primary concern and these products are a ticking time bomb that pose a serious health risk which may cause harm and/or death to unsuspecting consumers, so we urge extreme caution.

There are many entities and professionals who are involved with these Sham Companies in peripheral ways, such as web designers, manufacturers, advertising agencies, magazines, newspapers, medical professionals, physicians, and scientists. These entities and professionals are fully aware of the fraud and criminal conduct of these Sham Companies, yet they have agreed to participate for monetary gain. We will be identifying these entities and professionals on an  ongoing  basis in an effort to educate the general public.

Among these professionals is Dr. Jorge A. Villarreal, who is identified as the founder of a  company in Mexico identified as  Terapia Celular México (www.terapiacelularmexico.com). (Attachment S).

Villarreal posted a video on YouTube and GOOGLE where he  talks about the products offered for sale by his company, and in this video he  uses false and misleading information to confuse and defraud the consumer into purchasing these  fake, knock-off, and counterfeit products. These products are offered for sale through his company website under the  REVITALICELL brand, and the website contains false and  misleading information so that consumers believe that these products are manufactured in France, when they are not. These products are believed to be manufactured in Mexico. (Attachment T).

The attorneys for Biocell Ultravital (Switzerland), Biocell Laboratories (France), Biopharma International (USA), and Kurabiol Laboratories (USA), will pursue the following course of action against the Sham Companies, as follows:

  • Pursue a government investigation in the U.S. with the FDA and the FTC for the criminal conduct and fraud that has been committed by VITACELL, MXPHARMA, RCA LABS, TERAPIAS SALUD, REVITALICELL, PHARMABIOL, and ULTRAVITAL, and their principals. (Attachment U).
  • Pursue a government investigation in Mexico with “La Comisión Federal Contra el Riesgo Sanitario” (COFEPRIS) for the criminal conduct and fraud that has been committed by the Sham Companies and their principals in Mexico.
  • Pursue a government investigation with the equivalent of the FDA and the FTC in Venezuela, Panama, Colombia, Argentina, Spain, France, and Switzerland for the criminal conduct and fraud that has been committed by the Sham Companies.
  • File criminal complaints against VITACELL, MXPHARMA, RCA LABS, TERAPIAS SALUD, REVITALICELL, PHARMABIOL, and ULTRAVITAL, and their principals, with the proper authorities in Mexico, Venezuela, Panama, Colombia, Argentina, Spain, France, Switzerland, the U.S. and wherever it is appropriate.
